Term of sales

1 . GENERAL TERM OF SALES

The products are intended exclusively for the personal use of the purchaser,
without any direct connection with the professional activity of the latter.

2 . PRODUCT / PRICE

A – PRODUCT

The products offered for sale on the site which may possibly be attached to it are those which appear on the site, on the day of the consultation and within the limits of available stocks.

In case of unavailability of a product, the customer is informed of this unavailability:

 the size box is double-crossed and the size is not available. Please contact us by email sunbe.design@gmail.com in this case

SUNBE DESIGN does not have a physical store in France apart from its website, its facebook page “Sunbe Design” and its instagram page @sunbe_design. All the products sold by SUNBE DESIGN are listed on the company's websites / pages (hereinafter referred to as the “Products”).

SUNBE DESIGN does not distribute a paper catalogue.

B – PRICE

The amount of shipping costs is notified to the customer before the order is confirmed.

It is specified that any promotions granted in the form of reduction coupons cannot be combined with other reduction offers. 

SUNBE DESIGN reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the order is placed, subject nevertheless to the availability of said products.

C – CUSTOMS

Any order placed on the site, and delivered outside the European Union, may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These possible taxes or customs duties related to the delivery of an item are the sole responsibility of the customer and are his responsibility.

 

3 . REGISTRATION AND ORDER VALIDATION

A – ORDER MODALITIES

 

The customer views the products offered for sale on the day of viewing the site by browsing through the different product categories. The customer can select the products of his choice by adding them to the basket and then click on his shopping basket to see the contents of his basket appear on the screen.

The basket contains all the elements of the order and in particular the total amount including transport costs, the nature of the products ordered and their quantity. If the customer wishes to choose other products, he can continue browsing the site. 


The customer has the possibility, at any time during the ordering process - namely until the moment before payment, to return to this order, complete it, modify it, cancel it as long as the order is not validated definitively. 

Any order form signed with the click of validation constitutes an irrevocable commitment from the customer which can only be called into question in the case exhaustively provided for in this contract in the article "Right of withdrawal".

Once the selection of products is complete, the customer can order them by validating the order. From then on, a new page will open inviting the customer to:

- enter their username (email address) and password if the customer is already registered on the site; 

- or accurately complete a personal data collection form by filling in the required fields, in particular Last Name, First Name, E-Mail Address, Billing Postal Address, Delivery Postal Address.

The customer agrees to complete the form made available to him in good faith. The customer acknowledges that the data he communicates to SUNBE DESIGN and which is stored in SUNBE DESIGN's information systems are accurate and constitute proof of his identity. 

After entering their contact details and delivery address, the customer is informed of the amount of shipping costs. The customer is then invited to select and validate his method of payment. 

The order summary is displayed on the same page and includes all the information relating to this order, namely in particular the nature, quantity and price of the products, the overall amount (including transport costs and possible discount applied) of the order, billing and delivery details, delivery address and billing address.

After reading the status of his order, the customer will be invited: 

- either check the box "I have read and accept the general terms of sale" then click on the PAY MY ORDER button to definitively confirm your order,

 - or to use the menu at the top of the screen allowing him to modify his basket and to add or remove products. 

The data recorded by SUNBE DESIGN constitutes proof of all transactions between SUNBE DESIGN and the client

B- ORDER CONFIRMATION

Once the order has been confirmed and its payment has been validated, the customer has access to a printable and recordable summary of the order with in particular the references of the order. 

An order confirmation email is sent by SUNBE DESIGN to the email address provided by the customer and will include the following information in particular:

- the reference of the order recorded at the time of placing the order, 

- the summary of the order (description of the Product (s) ordered, quantity, size, price), 

- the total amount of the order, all taxes included, 

- shipping charges,

 - confirmation of payment.

In the event of a payment incident, the customer agrees to return the products received to SUNBE DESIGN from the first request.

In order to protect SUNBE DESIGN from abusive practices operated by unscrupulous individuals, and in the event that SUNBE DESIGN or the online payment provider suspects the fraudulent nature of an order, they reserve the right to ask the buyer (prior to processing the order), additional documents (in particular proof of address and debit in the buyer's name, photocopy of the Buyer's identity card, photocopy of the Buyer's bank card ) in order to verify that it is not fraudulent. 

In the absence of a response from the purchaser within fifteen days (15 days) following the sending of the request by SUNBE DESIGN or the online payment provider, the order will be canceled and SUNBE DESIGN will proceed as quickly as possible to reimbursement of this to the bank account debited when ordering.

C – ORDER PROOF

It is provided by express agreement between SUNBE DESIGN and the customer that e-mails will prevail between the parties as well as the automatic registration systems used on the site, in particular as to the nature and date of the order.

4 . SECURED PAYMENT and FRAUD

SUNBE DESIGN reserves the right to check the validity of the payment, before shipping the order, by any means that the seller deems necessary. 

SUNBE DESIGN reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered. In the event of fraud or suspicion of fraud, the seller reserves the right to remove any member without notice or compensation.

 

5 . SHIPPING

We decline any responsibility for the extension of delivery times due to the carrier, in particular in the event of loss of products, bad weather, strike or health situation. Please see our tab on delivery.

 Please note that some deliveries may be subject to customs taxes and deadlines

A – SHIPPING MODALITY

Once the order has been prepared, it will be sent to the postal address provided by the customer at the time of order.

B – SCHEDULE

In the event of an entry error, in particular the delivery address leading to a delay or impossibility of delivery, SUNBE DESIGN cannot be held responsible. All costs related to the reshipment of products due to a customer input error, or to his repeated non-presence during delivery by our partner will be borne by the client. 

Any delays or package loss on the part of the carrier do not entitle the customer to claim damages. In any event, the order will be executed within a maximum of three (3) working days (special case of pre-orders or the delivery time will be expressly indicated) from the day following that on which the buyer has validated his order, subject to full payment of the price and compliance with the purchase conditions. In the absence of delivery at the end of this period, the buyer will be able to cancel his order.

C – SHIPPING DELAY

Any delay in delivery must be reported as quickly as possible by the customer by email so that we can take the necessary measures with the responsible carrier.

D – RECEPTION

Each delivery is deemed to have been made as soon as the products are made available to the customer by the Carrier. The customer can follow the delivery of his package with a tracking number by consulting the carrier's website as well on the link provided in his order confirmation email. 

It is the customer's responsibility to check immediately upon receipt of the products the conformity and integrity of the products shipped. The customer agrees to send a letter of complaint by e-mail or by post to SUNBE DESIGN to notify damage or a breach within 7 days of the date of delivery of the products.

 Any anomaly / reservation identified at the time of delivery (in particular late delivery, missing or damaged product) must be fully and precisely indicated by the customer on the receipt provided by the Carrier when the products are made available and / or confirmed by registered letter to the Carrier within seven (7) days of receipt of the order.

Any such reservation must be notified to us at the same time and as soon as possible. A copy of the complaint addressed to the Carrier must be attached. 

If 14 business days after the shipment of the package, it is still not delivered, the customer can contact the post office closest to the place of delivery to obtain a follow-up of the order. If the package cannot be located, the customer must then contact SUNBE DESIGN

6 . RETURN PROCEDURE

A- RETURN MODALITIES

You have 14 days from the day of reception to request a return (while stocks last). SUNBE DESIGN does not issue item refunds.

Items that will be returned by the customer will receive a credit voucher valid for the purchase value of the product, not including shipping / delivery charges. This credit voucher is valid for a maximum of 6 months from the date it is sent to the customer by e-mail. The customer will have to pay the shipping fees for his new items.

 Please note, we do not accept returns on orders made during promotional periods, sales and other commercial offers.

The products must be returned complete, accompanied by all accessories, unworn, unwashed, unretouched and presenting the protective strip for the bikini bottoms or one-piece swimsuits, with their original label still attached.

We reserve the right to refuse returns that do not meet these conditions.

B – FORCE MAJEURE

Expressly considered as force majeure, in addition to those usually retained by the case law of French courts and tribunals,

- total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer failures, blocking of telecommunications including networks and in particular Internet. The occurrence of a case of force majeure will, initially, automatically suspend the execution of the order.

If beyond a period of three (3) months, the parties note the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.

7. COMPUTER LAW AND PRIVACY

In accordance with the amended Data Protection Act 78-17 of 6 January 1978, you have the right to oppose (art. 38), access (art. 39), rectification or deletion (art. 40) data that concerns you. This right is exercised, by proving his identity:by email: sunbe.design@gmail.com 

All personal data that is collected is treated with the strictest confidentiality. In particular, SUNBE DESIGN undertakes to respect the confidentiality of e-mail messages sent by means of e-mail.
